Terms of Service

1. Provider and scope

These terms govern your use of Better Infer (the “Service”), which is offered by Lukas Conrad, c/o IP-Management #5532, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany (“we”). The contract for the Service is formed when you register an account and accept these terms.

You buy account balance from Paddle, which acts as the seller of the balance (merchant of record). Paddle’s buyer terms and refund policy apply to that purchase. These terms cover how you may use the Service. Our Refund Policy and Privacy Policy are part of the arrangement.

2. The Service

Better Infer gives you pay-per-token access to large language models through an OpenAI-compatible API. The models are provided by third parties and run on GPU servers we rent. The available models and their prices are shown on our website and in the documentation. We may add, change or remove models.

3. Your account

• You must be at least 18 years old.
• The information you give us must be accurate, and you keep your email address current.
• Keep your password and API keys secret. You are responsible for everything done with your account and keys, and you tell us without delay if you suspect misuse.

4. Prices and balance

• Prices are per token, in US dollars (USD), as shown in the pricing section of our website. The price of a request is the price that applies when it is made. Paddle adds the applicable taxes at checkout; taxes are not part of your balance.
• We may change prices. An increase only takes effect every day at 00:00 UTC, and we publish it on our website at least 24 hours before. A decrease can take effect at any time. Look at the current price before you use the Service. A new price only applies to requests made after it takes effect and does not change the value of your balance in USD. If you do not accept an increase, you can ask us for a refund of your unused balance until 14 days after it took effect, whatever the age of the top-up (see the Refund Policy).
• Your balance is prepaid credit. It does not expire. Every request reduces it by the tokens used, at the price that applies to that request.
• Requests are only accepted while your balance is above zero. A request that is already running can take the balance slightly below zero. Until you top up above zero again, further requests are refused.
• Balance cannot be transferred or paid out. It is only returned as described in the Refund Policy.

5. Model licences

The models belong to their developers and often come with their own licences or usage policies. When you use a model through the Service, you comply with the licence and usage policy that applies to it.

6. Acceptable use

You may not use the Service to:

• break the law or infringe the rights of others, including generating or distributing illegal content;
• attack, defraud or deceive others, or create malware;
• bypass limits, security measures or billing, or put the Service under unreasonable load;
• resell, share or sublicense access to the Service or your API keys, or offer access to third parties in another way.

You are responsible for the data you send and for how you use the results.

7. Suspension and termination

We may suspend your account if we reasonably suspect a breach of these terms, a security risk or fraud. A payment that is reversed through a chargeback suspends the account automatically. While an account is suspended you cannot log in and your API keys are rejected. Contact us to have the suspension reviewed by a person.

You can end the contract at any time by asking us to close your account. We may end it for a serious breach of these terms. If we end it without you having breached these terms, we refund your unused balance.

8. Availability

We do not promise uninterrupted or error-free availability. GPU capacity is started on demand, so the first request after a quiet period can take longer. We may interrupt the Service for maintenance or because a provider we rely on is unavailable.

9. Model outputs and liability

Model outputs are generated statistically. They can be wrong, incomplete, offensive or infringe rights of others, and we do not check them. We do not develop the models and give no warranty that an output is correct or fit for a particular purpose. You decide whether and how to use an output, and you should have important results reviewed by a person, especially where errors could cause harm (for example in medical, legal or safety-critical uses).

Our liability is as follows:

• We are liable without limit for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee.
• For slight negligence we are liable only for the breach of an essential contractual obligation (one that makes the proper performance of the contract possible and that you can regularly rely on), limited to the damage that is foreseeable and typical for this kind of contract.
• In all other cases we are not liable.

This applies equally to the personal liability of our employees and helpers. Mandatory consumer protection laws of your country of residence remain unaffected.

10. Changes to these terms

We may change these terms for good reason, for example because the law, our features or the technical or economic conditions change. We tell you by email at least 30 days before the change takes effect and point out your options. If you do not agree, you can end the contract before the change takes effect and we refund your unused balance, regardless of the period in the Refund Policy. If you keep using the Service after the change has taken effect, it applies to you.

Prices are not changed under this section; section 4 applies to them.

11. Data protection

How we process personal data is described in our Privacy Policy.

12. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection provisions of the country where you live remain unaffected, and you can also bring claims before the courts that are competent under the law of that country.
